Florida criminal defense attorney Darren Finebloom of Finebloom & Haenel, P.A. won two DUI cases recently by challenging flawed breathalyzer tests and an unlawful detention of a citizen. He prevented the conviction of his clients on DUI charges, protecting their rights under the law.

In the first case, Finebloom’s client was stopped by law enforcement for speeding, and the officer noted signs of impairment, including an odor of alcohol. The defendant complied with all requests, submitting to a breathalyzer test and blowing over the legal limit (in the state of Florida) of .08 – in fact, the client’s breath tests were at .109 and .115. Attorney Finebloom made several challenges to the breathalyzer test and discovered new information showing that the machine his client was tested on was not in compliance. As a result, Finebloom set the case for trial, and the state attorney’s office offered to withhold adjudication on a reckless driving charge (no DUI charges) and there was no conviction.

In the second case, Attorney Finebloom’s client was arrested for a third offense DUI after being witnessed by another citizen stumbling to her vehicle. The witness flagged down a fireman who activated the emergency lights on his vehicle and detained the defendant until a police officer arrived. Finebloom, as part of his client’s defense, investigated further and determined that the defendant had a mild seizure at the time of the occurrence. He then filed a motion to suppress the evidence, based upon the unlawful detention of his client by the fireman under color of law – arguing that the fireman acted beyond the limits of his lawful authority to hold Finebloom’s client until law enforcement arrived on the scene. The court agreed, and granted the motion, suppressing all evidence in the case. The State Attorney’s office has since dropped the DUI charges against the client.
